Acceptance of the Terms of Sale

These terms of sale are entered into between you and COME ALONG WITH MISA LLC (“Owner,” “we,” or “us”). The following terms of sale, together with any documents they expressly incorporate by reference (collectively, “Terms of Sale”) govern the sale of goods (“Goods”) and any services (“Services”) carried out through your access and use of http://comealongwithmisa.co (the “Website“). 

Please read the Terms of Sale carefully before you begin to use or purchase any Goods or Services from the Website. By purchasing any Goods or Services from the Website, you accept and agree to be bound and abide by the Terms of Sale, our Privacy Policy [https://comealongwithmisa.co/privacy-policy/], and our Terms of Use [https://comealongwithmisa.co/terms-of-service/] incorporated herein by reference. If you do not agree to the Terms of Use, Privacy Policy, and Terms of Sale you must not access or use the Website.

Changes to the Terms of Sale

We may revise and update the Terms of Sale from time to time and at our sole discretion. All changes are effective immediately when posted on the Website. However, any changes to the dispute resolution provisions set out in Governing Law and Jurisdiction section will not apply to any disputes for which the parties have actual notice on or before the date the change is posted on the Website.

Payment

Accepted payment methods include American Express, Discover, Mastercard, PayPal, and Visa.

By entering into any transaction through the Website, you warrant and represent that all information you provide is true and correct, including without limitation: (i) your credit card information; (ii) your billing and shipping address(es); (iii) your email address; (iv) that credit card transactions submitted by you are authorized; and (v) that you are the legal holder of any credit card or payment account used on the Website. 

By entering into any transaction through the Website, you also consent to receiving email communications from us regarding this transaction, including purchase receipts, notices, or transactional messages. Further, you acknowledge and agree that all purchase receipts and purchase-related communications will be provided electronically only, and paper copies of receipts will not be provided.

Placing an Order & Our Acceptance

To place an order, please use the purchasing features on the Website. Your order constitutes an offer to us to buy the selected Goods or Services. After receiving an order, we will send you an e-mail to the email address you provide, acknowledging that we have received your order (“Order Confirmation”). However, the receipt of an email Order Confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell the selected Goods or Services.

All orders are subject to our acceptance, which we will confirm to you by sending you an email confirming the shipment of your order (“Shipping Confirmation”). Your receipt of the Shipping Confirmation forms a contract with us. The contract will relate only to the Goods and Services in the Shipping Confirmation. 

Information Accuracy & Cancellation

We may make changes to information regarding pricing and availability of Goods and Services without notice to you. We also have the right to correct any pricing errors or inaccuracies on the Website. 

We try to verify pricing information before shipping. If we find a pricing error with your order:

  • If the correct price is lower than the price you paid, we will charge you the lower amount. 
  • If the correct price is higher than the price you paid, we will (at our sole discretion) contact you at the email address you provided, or cancel your order and notify you of the cancellation. We are under no obligation to provide Goods or Services to you at an incorrect, lower price at any time, for any reason.

We reserve the right to cancel your order at any time before the Shipping Confirmation, and we may rescind our acceptance after the Shipping Confirmation and cancel your order, including but not limited to: (i) where there has been an error in price, (ii) where the Goods or Services are no longer in our inventory; or (iii) where we suspect fraudulent activity. We also reserve the right, without prior notice, to limit the order quantity on any Good or Service and/or to refuse service to any customer. We may also require verification of information prior to the acceptance and/or shipment of any order.

Once you place an order for Goods or Services through the Website, that order cannot be cancelled by you. Instead, see our return policy below. 

Shipping & Handling

Processing of your order generally takes 1-2 business days. Orders are shipped during business days, Monday-Friday (excluding holidays). If you have not received a Shipping Confirmation within 20 business days of your purchase, please contact us using the details provided in the Contact section below.

All orders are shipped via USPS. For accurate timelines and tracking for the shipping option you selected, please check the USPS website [https://www.usps.com/], using the tracking number provided in your Shipping Confirmation. 

For international orders, shipping costs and delivery times may vary based on location or customs protocols. All customs, duties and taxes are your responsibility. It is your responsibility to ensure that the products you order comply with the import regulations and national laws of your country. Owner is not responsible for any shipments delayed, held, or confiscated by customs due to non-compliance with local regulations.

We do not ship to P.O. Boxes or APO/FPO addresses. 

Shipping Limitations

When an order is placed, it will be shipped to an address designated by the purchaser as long as that shipping address complete and correct, and is compliant with the shipping guidelines of our third-party mail carriers. 

If the billing and shipping address(es) or other order information provided by you are not complete, consist of a P.O. Box or APO/FPO address, or otherwise contain errors, this may cause cancellation of your order, or a delay in shipping your order.

Risk of loss and title for items purchased from the Website pass to you upon delivery of the items to the carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

Returns

You may return your order for a full refund to your original form of payment within 30 days of delivery of your purchase. Returns must comply with the following guidelines:

  • Goods must be unused, include all parts or pieces, and be in the original packaging.
  • Goods must have been purchased directly from the Website.
  • You must include a proof of purchase with your return (such as a copy of the Order Confirmation or Shipping Confirmation).
  • Shipping and delivery fees are not refundable. 
  • All sale items are FINAL SALE and my not be returned.

You are responsible for charges for return shipments, including any customs, duties, or taxes required to return international orders. Returns should be shipped to:

We are not responsible for shipping losses when you mail your return, and cannot guarantee that we will receive your returned item(s). Only returns received by us will be eligible for refund. 

When we receive your return, we will process the return and your refund within 7-10 business days. Please note your banking or credit card institution may take additional time to process and post any transactions to your account. 

Damaged Goods

If your order arrives damaged, please take the following steps:

  • Notify Us Promptly. Contact us at info@comealongwithmisa.co within 48 hours of receiving the damaged item. Goods reported as damaged after 48 hours may not be eligible for a replacement. 
  • Provide Evidence. When contacting us, please include:
    • Your Order Confirmation email;
    • A brief description of the damage and any photos of the same.

Upon receiving your claim and verifying the damage, we can send you a replacement item, at no additional cost. If the Goods you ordered are no longer available, we may issue you a refund. We reserve the right to request a return of the damaged item for inspection, and will provide a prepaid shipping label, if needed.   

Exchanges

Currently, we do not offer exchanges for Goods and Services purchased on the Website. If applicable, you should return the item you wish to exchange, in accordance with our return policy above.  

Product Colors and Quality

We make reasonable efforts to accurately display our Goods, including the applicable colors and quality. However, the colors and quality you see will depend on the device with which you are viewing the Website. We cannot guarantee that your device will accurately display such colors and quality. 

Sweepstakes & Contests

We may or may not offer sweepstakes and/or contests through the Website. These sweepstakes and contests may have their own rules, which will be laid out accordingly. 

Ordering From Third Party Sites

We are unable to assist with or process returns of any items bought from third-party sites or marketplaces, such as Amazon. If you bought items from a third party, please contact them directly with any inquiries or concerns.
