This Policy explains how we collect information through our Website, newsletters, and offline at COME ALONG WITH MISA™ events, as well as how third-party platforms may collect information during the purchase process.  Please note that our Website does not have direct e-commerce capabilities. Instead, we use third-party platforms like Shopify and Amazon to handle all transactions and purchases for our COME ALONG WITH MISA™ products featuring Misa. 

By engaging with our Website, downloading our lesson plans or activity pages, enrolling in our COME ALONG WITH MISA™ Birthday Card Program, or using our other Services, you acknowledge and consent that you have read and understand our privacy practices explained in this Policy.  If you do not agree with our policies and practices, do not access or use our Website or our Services.  We may also update this Policy from time-to-time, as further explained below in Section 16 Updates to our Privacy Policy.

1. Information We Collect and How 

We collect limited personal and non-personal information when you use our Website to browse our COME ALONG WITH MISA™ books, toys, and other products; download COME ALONG WITH MISA™ lesson plans or activity pages; attend our COME ALONG WITH MISA™ events; or use or sign-up for our other Services.  Please note, however, that do not process or collect payment card information directly on our Website.  Below is an overview of the type of information we collect:

• Standard Identifying Information.  Standard identifying information that identifies you, such as your name, mailing address, telephone number, or email address.  For example, we will ask you to provide standard identifying information when you sign up for one of our Services, request to be on our mailing list, or contact us with a question or concern.  

• Product Search History.  When you look at COME ALONG WITH MISA™ products on our Website, we collect information about search queries and viewing history.

• Purchase Transaction Information.  COME ALONG WITH MISA™ fans may purchase items displayed on our Website through third-party platforms like Shopify and Amazon.  We do not collect or process payment information, shipping addresses, or other transaction details on our Website. These details are handled by third-party platforms like Shopify or Amazon.  However, we will receive confirmations of purchases and receipts from payment information processed securely through third-party payment gateways.  We will also receive product feedback and aggregated sales data from these third parties.  

• Customer Support Information.  When you have an inquiry or engage with our customer support team, we collect information necessary to allow us to assist you, such as your name, contact information, order history, and communications you choose to share with us.

• COME ALONG WITH MISA™ Birthday Card Program.  We offer the COME ALONG WITH MISA™ Birthday Card Program to parents whose children love Misa.  We collect information provided by parents through our COME ALONG WITH MISA™ Parental Consent Form when they request birthday cards and correspondence from Misa for their children, as described in more detail below in Section 6 COME ALONG WITH MISA™ Birthday Card Program.        

• User-Generated Posts and User-Generated Content.  When you share posts about where Misa has traveled, write testimonials, or submit other user-generated content (collectively, “User-Generated Content”) through our Website or social media, this User-Generated Content will become public and accessible by anyone.  We may use or share your User-Generated Content on our Website or social media accounts to promote our Website, COME ALONG WITH MISA™ products, and Services.  Please note that we do not control who will have access to your User-Generated Content when you post it on third-party websites or social media and cannot ensure that third parties will be responsible for maintaining the security or accuracy of your User-Generated Content. 

• Sensitive Personal Information. There may be instances when information you share with us includes sensitive personal information. The definition of “sensitive personal information” depends on where you live and applicable privacy laws.  Examples of sensitive personal information include information you share about your children.  We only process sensitive personal information that you share with us for the purposes of (i) fulfilling your request for Misa to send your child a birthday card and other correspondence; (ii) processing or fulfilling other Services per your request; or (iii) carrying out our legal obligations or exercising specific rights as permitted by law.  

• Information from Your Device.  When you visit our Website or use our Services, information about the device or browser you use may be shared with us, including IP address, mobile carrier, telephone number, browser type and language, operating system, and location (if enabled on your device).  We may also determine what technology is available through your browser to serve you the most appropriate version of our Website.  

• Usage Data. We may also collect information about how your device or browser interacts with our Website, such as the content you access, pages visited before and after you reach our Website, the date and time of your use, the amount of time spent on our Website, and other actions taken through use of our Website. This data is collected primarily through Google Analytics (via Monster Insights Pro), which helps us analyze how users interact with our Website.  We use this data to better understand how you use and interact with our Website and Services, which allows us to improve our Website and offerings.  For more information, see Section 3 Use of Google Analytics via Monster Insights Pro and Section 10 Cookies below.

• Internet or Other Network Activity. We collect information about your internet activity, including browsing or search history and interactions with our Website.  We use this information to better our Website and Services and gain insight from our marketing and advertising campaigns. We collect information from Google Analytics, social media analytics, or other technologies and may use this information to supplement your information maintained by us.  For more information, see Section 10 Cookies below.

• Social Media. If you access our Website through third-party social media sites such as Instagram or Facebook, we may collect information about you from that third-party social media site, including information you have made public via your privacy settings, such as your profile name or social media handle, profile picture, and your social media contacts or friends.

2. Third-Party Platforms for E-Commerce

Our Website include links and references to third-party e-commerce platforms like Shopify and Amazon for purchasing our COME ALONG WITH MISA™ products. When you click on these links to purchase a COME ALONG WITH MISA™ book, toy, or other item on our Website, you will be directed to these third-party e-commerce platforms, and their privacy policies will govern the collection and use of your personal information shared during your transaction.

3. Use of Google Analytics via Monster Insights Pro

We use Google Analytics via Monster Insights Pro to track and analyze how visitors use our Website. This tool helps us understand visitor behavior, improve our content, and enhance your overall experience on our Website.

Google Analytics collects non-personal information, such as:

• The pages you visit.
• The amount of time you spend on our Website.
• Traffic sources (e.g., whether you came to our Website from a search engine or social media).

5. Mailchimp for Newsletters

We use Mailchimp to manage and distribute our newsletters and promotional emails. When you subscribe to our COME ALONG WITH MISA™ newsletter, we collect your name, email address, and any other information you voluntarily provide.

Mailchimp may collect additional information about how you interact with our emails, including:

• Whether you open an email.
• Links you click on within the email.

This data helps us improve our email marketing campaigns and provide relevant content. Mailchimp processes this data in accordance with its terms and policies.

You can opt out of receiving newsletters at any time by following the unsubscribe prompts in our email communications or by contacting us directly at info@comealongwithmisa.co.

6.  COME ALONG WITH MISA™ Birthday Card Program

With parent’s or legal guardian’s explicit consent, we offer a unique service where Misa, the main character of the COME ALONG WITH MISATM books, can send a birthday card and correspondence directly to the child. When signing up for this service, parents or legal guardians provide the following additional information:

• Child’s first name.
• Child’s birthday.
• Mailing address for the child.
• Any special instructions (e.g., favorite themes or messages).

We use this information solely for the purpose of sending personalized birthday cards or correspondence from Misa to the child. This data is processed based on parental consent and is stored securely. Parents and legal guardians may withdraw their consent at any time by contacting us at info@comealongwithmisa.co, and we will promptly stop the service and delete the child’s information.

7. Why We Use Your Information

We use your information for the following purposes:

• Access to our Website. We use your information to operate, improve, maintain, and personalize our Website.   

• Provide our Services.  Provide you with our Services, including downloads of COME ALONG WITH MISA™ activity pages and lesson plans or facilitating Misa sending your child a birthday card and correspondence at your request.

• Communication and Support. We use your information to communicate with you and provide support when you request it.  We may also use this information to train our staff to provide customer support services in connection with future requests.  See Section 9 Communications With You below for more information.  

• Marketing and Promotions. We use your information to market our COME ALONG WITH MISA™ products and Services, which may include contacting you by email about news, offers, products, promotions, events, and/or Services that might be of interest to you, as permitted by applicable law and/or with your consent.  If you would like to unsubscribe from our marketing communications, please follow the unsubscribe prompts in our email communications or contact us at info@comealongwithmisa.co. 

• Analytics, Research, and Development. We are continuously trying to improve our Website and offerings as well as your experience.  We may use your information for these business purposes, including:
• Monitoring and measuring your use of our Website, COME ALONG WITH MISA™ products, and Services and conducting research to understand how they are being used and how they can be improved.  We use analytic tools and programs to perform these functions, including, but not limited to, Google Analytics and social media analytics. 
• In some cases, information may be anonymized, compiled, and analyzed on an aggregated basis. We may share this aggregate data with our service providers, distributors, and other third parties with whom we do business. This aggregated information does not identify you personally.
• Analytics for Advertising.  We use information from your browser or device and analytic tools to serve you with advertising about our COME ALONG WITH MISA™ products and Services on third party social media platforms.  For example, we use analytic tools to understand and measure the effectiveness of our ads displayed on third-party platforms.     

• Security and Integrity of Our Website. Providing a safe and secure environment is key to providing a responsible website and we do this by using your information to:
• Authenticate and verify your identity;
• Detect and combat any harmful activity, abuse, fraud, spam, and illegal activity affecting our Website, Services, and related operations;
• Monitor content on our Website; and
• Prevention and detection of crime. 
• Compliance. We may use your information to investigate disputes or claims related to our Website, COME ALONG WITH MISA™ products, and Services. In certain circumstances, we may be obligated to use your information to respond to legal, government, or regulatory requests and comply with our obligations under applicable laws and regulations. We may use the IP address associated with your device to determine your general location in order to comply with governing privacy regulations and serve you necessary notifications and/or consent mechanisms.

• Contractual Obligations.  We use your information to perform the Services you request.  We may also use your information in the performance of our contractual obligations with service providers we contract with to provide you certain Services in connection with your use of our Website and processing your orders, such as GoDaddy, Shopify, and Amazon.

• Protecting Vital Interests, Rights, and Lawful Business Purposes.  From time-to-time, we may use information for safeguarding and defending our vital interests, exercising any rights we may have under law or contract, asserting any claims or defenses, and for any other lawful business purpose. This includes any incidental business purpose related to or in connection with any of the above, or for any other purpose disclosed to you at the point at which we collect your personal information.

8. Who We Share Your Information With

We do not sell your personal information as the term “sell” is commonly understood.  We do not use your personal information for the purpose of inferring characteristics about you.  However, we may share your personal information to the following categories of recipients for the purposes described in this Policy, and these may be considered a “sale” or “sharing” under certain privacy laws.

Service Providers. We may share personal information with trusted service providers, such as technology partners, web developers, analytics providers, cloud storage providers, or other providers that need access to your information to provide operational or other support services while you use our Website.  Such service providers include, but are not limited to, GoDaddy, Square Peg Marketing & Branding, LLC, Google Analytics, Flywheel, WordPress, Gravity Forms, Complianz, and other social media analytic providers.  

Business Partners.  We may share personal information with our business partners who assist us in providing the Services, such as mail carriers; advertising and marketing partners; research partners and consultants.  Such business partners include, but are not limited to, United States Postal Service, Shopify, Amazon, MailChimp, Google Analytics, and other social media analytic providers.

Advertising Platforms.  We may contract with third-party platforms to display ads on their services, such as Amazon. These companies may use cookies and similar technologies to track your activity.  The information collected by these third-party platforms in this manner is subject to their own privacy policies.  

Government Agencies, Regulators, Law Enforcement, and Courts.  We may share your personal information with competent law enforcement bodies, regulators, our insurers, outside legal advisors, government agencies, courts, or other third parties where we believe disclosure is necessary to: (i) comply with applicable law; (ii) exercise, establish or defend our legal rights; (iii) protect our rights or vital interests as well as those of any other person; or (iv) detect, prevent, or otherwise address security, fraud, or technical issues.

Potential Buyers (and their agents and advisors). We may share your personal information with actual or potential buyers (and their agents and advisors) in connection with any actual or proposed purchase, merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of COME ALONG WITH MISA LLC, or our assets, or the transition of Services to another provider.  In such a case, we will inform the buyer or transferee that it must use your personal information only for the purposes disclosed in this Policy.

Aggregated Data.  We may disclose information that has been aggregated or does not identify any individual or device without any restrictions or limitations.

We  may contact you at any email address you provide to: (i) verify your identity, including your phone number, email address, or other contact information; (ii) confirm your request to be on our mailing list; (iii) confirm your request to have Misa send your child a birthday card and correspondence; (iv) send you news and updates about our Website, COME ALONG WITH MISATM products, or Services; (vi) resolve a dispute; (vii) poll your opinions through surveys or questionnaires; (viii) enforce our Terms and Conditions [https://comealongwithmisa.co/terms-of-service/] and/or (ix) or protect our rights or interests available under applicable law. 

As a valued COME ALONG WITH MISATM fan, we will notify you via email (including autogenerated email messaging through MailChimp or other service provider) about new COME ALONG WITH MISA™ products, Services, and special money-saving offers. You can opt out of receiving these offers at any time by emailing us at  info@comealongwithmisa.co or by clicking on the unsubscribe link in our promotional emails.  

If we communicate with you over the telephone or other communications device, we may monitor or record conversations with you, or anyone acting on your behalf, for quality control and training purposes, or for our own protection.

Our automated systems may scan and analyze the contents of every message sent through the messages platform on our Website to detect and prevent spam, phishing, fraudulent activity, or violations of our Terms and Conditions [https://comealongwithmisa.co/terms-of-service/]. This may result in a manual review of messages sent through our messaging tools. This scanning and analysis may occur before, during, or after the message is sent, or while in storage, and may result in your message being delayed or withheld. We may store message contents to conduct this scanning and analysis.

10.  Cookies

Like many websites, we use cookies, pixels, and other tracking tools and technologies for functionality, performance, statistics, and marketing analytics (collectively, “Cookies”) on our Website.  We use Cookies to remember your settings between sessions, keep track of advertisements, and to compile aggregate data about Website traffic and Website interaction, all of which allow us to offer you a better experience on our Website. We contract with third-party service providers like Google Analytics to assist us in better understanding our Website visitors. We also use Cookies for social media integration and to gather information on how users interact with our ads located on third-party platforms, such as Amazon. We use email marketing analytics via Mailchimp.

Depending on your device or search engine, you can choose to have your computer warn you each time a Cookie is being sent, or you may be able to turn off all Cookies via your browser settings. Like most websites, if you turn your Cookies off, some of our Services may not function properly.

11. Privacy of Children

Mireya Saldúa cherishes her young COME ALONG WITH MISA™ readers.  Protecting children’s privacy is important to us. Our Website is designed for parents, guardians, and teachers to browse and review Come Along With MisaTM books and toys featuring Misa and print lesson plans or activity pages for children. We do not knowingly collect personal information from minor children without verifiable parental consent.  

All birthday cards and correspondence from Misa through our COME ALONG WITH MISA™ Birthday Card Program are initiated and managed by parents or legal guardians. If we learn that we have inadvertently collected personal information directly from a child without parental or legal guardian consent, we will take immediate steps to delete it.

12. Privacy Rights and Preferences

Our Website is operated in the United States.  If you reside outside of the United States, please be aware that any information you provide to us will be transferred to and processed in the United States.

Residents of U.S. States

Depending on where you live, you may have certain privacy rights established by law, such as:

1. Access and Data Portability. The right to verify whether or not your data is being processed by us and then gain access to the data, including receipt of an electronic copy of your data.
2. Correction. The right to request that we correct inaccurate personal information that we maintain about you.
3. Deletion.  The right to request that we delete your personal information at any time.  Subject to certain exceptions, including verification of your identity, authorization, and fulfillment of your request, we will delete your information if you make such a request.  After honoring your deletion request, we may retain personal information that is necessary for us to comply with our legal obligations or that is not otherwise subject to deletion under applicable law.
4. Appeal.  The right to appeal our denial of your request to access, correct, or delete your personal information.  
5. Opt Out of Sales, Shares, and Online Behavioral Advertising.  We do not sell your personal information as the term “sell” is commonly understood.  To the extent our advertising activities fall within the definition of “sale,” “cross-context behavioral advertising,” or “targeted advertising” as those terms are defined under applicable privacy laws, you have the right to opt-out of the use of your information for such advertising activities and marketing Cookies.

Limit Use and Disclosure of Sensitive Information.  We collect and process sensitive information to perform the Services you expressly request and for other business purposes permitted by applicable privacy laws.  Our use of any sensitive information does not trigger opt-out rights under applicable privacy laws.

Anti-Discrimination.  We will not discriminate against you for exercising any of the aforementioned rights when afforded under applicable laws.  At times, however, providing your personal information may be necessary for us to provide the Services you request such providing activity sheets and lesson plans, fulfilling your request for Misa to send a birthday card to your child, responding to your inquiries and feedback, or adding you to our mailing list. In the above referenced circumstances, refusal to provide your personal information would make it impossible for us to perform our obligations or to provide the requested Services.
8. Rights related to Automated Decision-Making.  You have the right to be informed about automated decision-making processes that legally or significantly affect you.  

Providing your personal information for survey or other marketing purposes, as above specified, is optional.  Refusal to provide your personal information for these purposes will not have any impact on your orders or the performance of our Services listed in the preceding paragraph. When required under applicable data protection laws, we will collect your prior consent before processing your personal data for these other purposes.

If you are a Canadian resident, you may have certain rights under applicable Canadian laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and successor legislation. 13. Data Retention

We retain your personal information we collect or receive as described in this Policy for the purposes for which it was collected and to provide our Website, COME ALONG WITH MISA™ products, and Services to you, communicate with you, training of employees, establish legal defenses, conduct audits, research and development of new products and services, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.  For example, we keep your name and email address as long as you subscribe to our mailing list.  We keep your name, email address, child’s name, birthday, and mailing address until the parent withdraws consent to Misa sending birthday cards and correspondence to the child.  

To determine the appropriate retention period for your personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information, and the applicable legal requirements.  When we no longer need your personal information for a business purpose, or are no longer required to retain the personal information as described above, we will destroy, erase, or anonymize it.  However, legal requirements (such as record retention requirements or litigation holds) may require us to retain some or all of the personal information we hold for a longer period of time even after our business purpose or need expires.
